By creating an account and accessing or using Hillis Auctions website, you (“User,” “Bidder,” or “you”) agree to comply with and be bound by the following Terms & Conditions.

1. Eligibility

Users must be at least 18 years of age and legally capable of entering into binding contracts. By registering, you represent and warrant that you meet these requirements.

2. Account Registration & Security

You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

3. Bidding & Auction Participation

- All bids placed are binding and irrevocable.
- By placing a bid, you are entering into a legally binding contract to purchase the property or item if you are the winning bidder.
- The Company reserves the right to accept, reject, or cancel any bid at its sole discretion.
- The Company may establish minimum bids, reserve prices, and bid increments.

4. Buyer’s Premium & Fees

A buyer’s premium and/or additional fees may be applied to all purchases. These fees will be disclosed prior to bidding and are the responsibility of the bidder.

5. Payment Terms

- Payment must be made in full within the timeframe specified for each auction.
- Accepted payment methods will be outlined in the auction terms.
- Failure to complete payment may result in forfeiture of deposits, suspension of bidding privileges, and/or legal action.

6. Real Estate Transactions

- All real estate sales are subject to specific auction terms, including but not limited to earnest money deposits, closing timelines, and contract requirements.
- Buyers are responsible for conducting their own due diligence prior to bidding.
- Properties are sold “AS IS, WHERE IS” with no warranties or guarantees expressed or implied.

7. Personal Property Sales

- All personal property is sold “AS IS, WHERE IS” with no guarantees.
- Descriptions are believed to be accurate but are not guaranteed.
- No refunds, returns, or exchanges will be permitted.

8. Inspection & Due Diligence

Users are encouraged to inspect all items and properties prior to bidding. Failure to inspect does not relieve the bidder of responsibility.

9. Default & Remedies

If a winning bidder fails to complete the transaction:

- The Company may retain any deposits or payments made.
- The Company may resell the item or property.
- The defaulting bidder may be held responsible for any resulting losses, fees, and legal costs.

10. Limitation of Liability

Hillis Auctions shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the website or participation in auctions, including but not limited to bidding errors, system failures, or inaccurate listings.

11. Technology & Platform Use

- The Company does not guarantee uninterrupted or error-free operation of the website.
- In the event of technical issues, the Company reserves the right to pause, extend, or cancel auctions.

12. Compliance with Laws

Users agree to comply with all applicable local, state, and federal laws regarding bidding, purchasing, and ownership.

13. Privacy

Your use of the website is also governed by our Privacy Policy. By creating an account, you consent to the collection and use of your information as outlined therein.

14. Modifications

Hillis Auctions reserves the right to update or modify these Terms & Conditions at any time without prior notice. Continued use of the platform constitutes acceptance of any changes.

15. Governing Law

These Terms & Conditions shall be governed by the laws of the State of Tennessee.

16. Agreement

By creating an account, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.
